1.USAGE OF THE SITE WEB
Usage of the web site www.dream-flats.com is limited to private use and any commercial exploitation will never be accepted. You have no rights to make copies of the pages or of parts of them, nor to present it, publicise it, expose it, change it or create a page, which is based on it without the permission of Insight Communication Group S.L. The right to use the website for searching informations or making bookings is only given to persons older than 18 years, individuals, juridical persons, or representatives of institutions or companies. Your booking on this website is conditional on accepting the terms. If you do not agree with any part of them, you must not proceed with your booking. By completing your booking you accept that you have read, understood and accepted the terms & conditions. We reserve the right to change the website or parts of it and its content whenever we consider it necessary. Although every effort has been made to ensure the accuracy of the information give on the website, the information provided is only informative material and is dependent on a third party. As such we cannot be held responsible for the information.
When booking any services offered by our partner VIATOR through our website, please note that their Terms and Conditions apply accordingly.
2. RESERVATIONS / BOOKINGS
Insight Communication Group S.L. accepts requests only through correctly filled in forms on our site. All questions regarding confirmations, services details, cancellations must be made by e-mail or fax, in writing or in person. By making a reservation the prospective customer agrees to conclude a contract according to the (here available) conditions and will be called from here on client. By sending back a confirmation of booking by dream-flats.com (in the name of Insight Communication Group S.L.) by e-mail, fax or mail a valid contract is made. The client has to verify that all the informations in the confirmation email are correct and to notify Insight Communication Group S.L. within three days of any possible changes. Failure to notify us within this period will mean, that the client accepts the reservation as stated. The correction of mistakes due to typing or calculation errors is reserved. The client has the sole responsibility for all obligations, which could arise from the contract and will be responsible for all the persons included in his reservation.
Lodging (apartment):
The availability of the accommodations is updated continuously during night and day, 365 days a year. If nevertheless you as a user send to Insight Communication Group S.L. a request of a booking and the lodging is already booked out we will inform you immediately with the available alternatives. If it is decided not to accept any of them, all the personal information, including that of the credit card will be erased immediately. Payments already done by transfer will be refunded without any fee.
For apartments you might choose different methods of payment. Then the reservation becomes effective the moment that Insight Communication Group S.L. receives the money due in our bank account, in cash, or, in case of bank transfer, the fax receipt of the transfer wire. Confirmation of reservations made by bank transfer might take up to 1-3 days. The contract text of all reservations is stored and you can see the Terms&Conditions of the contract at all times on this web site. The specific order data are not recallable for reasons of safety on Internet and are treated in accordance with our data security regulations confidentially.
3. RATES
All rates are quoted in euros (€) and will always be confirmed when Insight Communication Group S.L. invoices the client. Before booking on line you will be shown the total price, including VAT, as well as a breakdown of the amounts you are paying for.
Currency rates are updated regularly, several times a day. In rare cases rates might vary slightly.
Additional charges accommodations:
Usually our rates for renting do include charges like water and elettricity. Additional charges are to be paid to the owner/guardian of the apartment. Please make yourself fully familiar with any additional charges if they are stated on the web page. The accommodation costs do not include: transfer between airport and accommodation, excursion and other personal expenditure, additional charges for rooms, meals or under-occupancy in apartments, charges that apartments may make for facilities such as coats, minibus services, sundbeds, sauna, tennis courts, etc. Some apartment owners request deposits on arrival.
4. SERVICE ORDERS
When pressing the book now button after filling in all your personal dates and credit card details the user authorises Insight Communication Group S.L. to charge his/her credit card (or other approved facility) for any and all purchases of services made by him through Insight Communication Group S.L. He agrees not to report as lost or stolen any credit card which he has used in conjunction with payment to Insight Communication Group S.L. for services which he/she does not have good reason to believe is, in fact, lost or stolen. He further agree not to report as unauthorised any charge for services which he has, in fact, ordered from Insight Communication Group S.L. He/she agrees that any such false reporting of a lost or stolen credit card or of unauthorised charges shall render him liable to Insight Communication Group S.L. The liability for liquidated damages specified in this Paragraph shall not limit any other liability he may have for breach(es) of any other terms, conditions and warranties set forth in this Agreement.
5. PAYMENT
Apartments:
Insight Communication Group S.L. will send you the booking confirmation, as soon as they receive the prepayment by bank transfer (or the fax copy of the wire transfer as a proof) or after having charged your credit card for the amount of the prepayment. The outstanding amount must be paid in cash directly to the owner on arrival or at a minimum of 45 days prior to arrival. The type of payment is stated for every accommodation before you make the reservation. In some cases, mainly for longer stays, the owner has the right to charge the first month rental upfront before the arrival date.
Methods of payment:
We accept payment by credit cards (Visa, EuroCard/MasterCard and Maestro) and by bank transfer. Customers must pay all bank commissions that may occur. If you pay by bank transfer, please indicate your name on all transfer documents. It is very important to send us the receipt of the wire transfer (with your name, passport nr., complete address, telephone and email address) by fax. We can only reserve the accommodation after we have received this fax.
Invoices: If an invoice is required for the total amount of a reservation, please contact us before making the booking.
6. SECURIZATION OF PAYMENTS BY CREDIT CARDS
In the moment you’ll communicate your personal data’s you will find a certified secure page. Your transaction and your credit card details are protected. Your security is of the up most important to us. All the services provided on dream-flats.com have been established with particular regard to your privacy and safety. However, if you would like to make a booking it is necessary to transmit your personal data to our server.
Due to the SSL (Secure Sockets Layer) system installed on our site (Bank server), your credit card information – if you choose payment by credit card – can be transferred to us via internet without being viewed by any outside sources. It represents an encrypted link between the bank server and your browser, which ensures that all communication between your and our system will remain confidential.
All of our users information, not just the sensitive information mentioned above, is restricted to our offices. All employees are kept up-to-date on our security and privacy practices. If payment is made through our automatic payment system then the credit card processing is done by Banco Santander Central Hispano S.A., Paseo de Gracia 5 Barcelona 08007.
7. CONFIRMATION
Our instant booking system applies for Barcelona, Prague, Paris, Amsterdam and Rome Apartments booking. In these cases a booking confirmation will be send in the very moment of making the reservation if making payment with credit card and filling in all the fields necessaries for processing it. All other bookings and email enquiries will be answered within 24 hours after the request is made except over the weekend. Our offices close on Friday afternoon at 5pm and re-opens on Monday morning at 9.00am Spanish time.
8. CANCELLATIONS
All cancellations must be made by e-mail or fax to the personal manager. Please note that our conditions for cancellation differ depending on when the cancellation is made. Our conditions for the cancellation of short-time rentals depend on when the client cancels the reservation. The cancellation policies apply to all paid and confirmed payments made by the client until the day of the cancellation. Important note: the % of pre-payment (when you confirmed your reservation) is never refaudable.
- 76 or more days before arrival: Full refund of the amount to pay on arrival. The % of pre-payment (when you confirmed your reservation) is never refaudable.
- 46 until 75 days before arrival: 50% refund of the amount to pay on arrival. The % of pre-payment (when you confirmed your reservation) is never refaudable.
- 45 days and less before arrival or during your stay: There is no refund of any paid and confirmed payment. The % of pre-payment (when you confirmed your reservation) is never refaudable.
- Less than 10 days before the arrival: we will charge 50% of the total amount of the stay.
- Less than 24 hrs or without previous cancellation: we will charge the total amount of the stay.
These amounts will be refunded or charged from the same credit card of the reservation.
We recommend that clients make a travel insurance, which cover their travel.
Changes of bookings (apartments):
To change a booking, it is necessary first to cancel the one you want to change and then to make the new one.
9. CASE OF FORCE MAYOR
The tenant is not freed from the responsibility of payment due to personal circumstances or force mayor, which shall include (but are not limited to) war, strikes or natural catastrophes.
10. CHECK IN / CHECK OUT
If you have reserved accommodation the normal procedure is to go directly to the address indicated in the accommodation confirmation that Insight Communication Group S.L. sends you. The owner/guardian will handle the check in, the check out and will give you the keys. Check in time is between 4:00 pm and 9:00 pm. In case of delay the owner/guardian has to be advised immediately. Check out must be before 11:00 am.
In case of a delay in the occupation of the accommodation, or in case of an unanticipated departure, there will not be any change of the total rental price.
Arrivals after 9:30 pm will have an extra charge of 30 Euros.
Arrivals after 01:00 am will have an extra charge of 50 Euros.
On arrival to the accommodation, please give a copy of your identity papers to the owner or the guardian of the domicile for legal prescribed registration. The owner or guardian of the domicile has the right to refuse admittance guests who do not present identity papers. It is not permitted to stay in the accommodation with persons other than those mentioned on the booking form or those who are with you on arrival. Any change of persons during the stay is strictly forbidden, except when prior to arrival permission, has been asked of the owner and granted by him. Furthermore it is not permitted to stay in the accommodation with more people than mentioned in the booking confirmation. In such cases the landlord has the right to ask you to immediately vacate the premises.
11. SECURITY DEPOSITS
Insight Communication Group S.L. does not collect or disperse security deposits. Security deposits might be charged for bookings of apartments and have to be handed over to the owner or guardian of the domicile. The collection of the deposit is done through the same procedure. Insight Communication Group S.L. does not get involved with the security deposits whatsoever. We cannot be held liable for the loss of a security deposit for any reason whatsoever, nor can we be held liable in anyway due to a dispute arising from a security deposit. The owner or guardian of the domicile has the right to refuse admittance to guests who do not pay the deposit if required. On the day of departure of the client the owner or the guardian is obliged to refund the deposit of guarantee (this excludes demands made for possibly damage caused) only after a checking to the accommodation. The deposit is paid as a guarantee to ensure no damage is done to the accommodation. In the case where a landlord retains part of or the complete deposit the landlord is advised to hand in a written report on the damages done to justify the retention of the deposit to Insight Communication Group S.L.
12. BEFORE AND DURING THE STAY
Insight Communication Group S.L. and its supplier are not liable for damages or losses that may result from travel to any particular destination. It is your responsibility to ensure you have the relevant visa for the country you are visiting, plus any inoculations required.
You will have to treat the accommodation you are renting and all of the equipment that belongs to the accommodation with cares. Possible rules of the accommodation and its environment have to be respected in all moments and you will also have to respect the neighbours.
If there is any damage done to the accommodation or to the equipment in it, it has to be communicated immediately to the hotel or the owner/guardian. You will be held responsible for any damage of the accommodation or the equipment, done by you or one of your travel passengers.
13. DOMESTIC ANIMALS
Bringing along domestic animals normally is not permitted in all accommodations if not otherwise stated in the description of the accommodation. In certain cases (blind dogs, pets for psychological disturbed children, etc.) it is possible that the hotels or property owners will give special permissions. Please inquire prior to reservation if you may bring along the animal.
14. DESCRIPTION OF ACCOMMODATION
The property owner provides all informations regarding the accommodation, including photos and prices. Insight Communication Group S.L. does its very best to verify this information and keep it up to date, but Insight Communication Group S.L. can never be held liable for the content in the descriptions of the accommodation.
15. PRIVACY POLICY
Insight Communication Group S.L. wants to demonstrate its commitment to your privacy. If you are interested in learning more about what personal information is being gathered by our site, which is collecting the information, how the information will be used or with whom the information will be shared with, please consult our PRIVACY STATEMENT.
16. CLAIMS
In case of claims against the accommodation you have to communicate them immediately to the owner/guardian. If not you will loose all rights of compensation. If the reasons for the claim have not been eliminated in an appropriate period of time it has to be communicated to Insight Communication Group S.L. Any demand of compensation has to be presented in written form to Insight Communication Group S.L. within one month. Later demands cannot be respected.
17. RESPONSIBILITY
Insight Communication Group S.L. acts as an agent for private accommodation owners. Therefore Insight Communication Group S.L. can never be responsible for delays, accidents, losses, changes of schedules and rates, damages, etc. (neither for persons nor for objects), that may occur in any of its suppliers services.
Insight Communication Group S.L. or its employees are not responsible for:
· errors, omissions, or misspelled words
· misrepresentation by third parties
· personal damages or injuries incurred while staying in one of the accommodations of this Web site
· disputes between a consumer and a third party
· content of external links you will find on our website
The service of Insight Communication Group S.L. ends with the preparation and with issuing of the documents of your booking. This can be by email, fax, personally in the office of Insight Communication Group S.L. or by mail if the client so wishes. In the last case Insight Communication Group S.L. reserves the right to charge an additional 25 euros.
Insight Communication Group S.L. is responsible to exercise the diligence of a respectable business for the conscientious preparation, the careful monitoring and selection of the service providers and the respectable contribution of the agreed services taking into consideration local and national customs. Our liability is excluded or limited if, on the basis of agreements or international legal norms in force, which must be applied to the services of the proprietor of a service, the liability of this proprietor is likewise excluded or limited. Insight Communication Group S.L. does its very best to verify all the information that content the web site www.dream-flats.com and to keep it up to date, but Insight Communication Group S.L. can never be held liable for its content. The responsibility of Insight Communication Group S.L. is limited to the total amount of the services paid for. It is not liable for any acts, omissions, breaches or negligence of any suppliers or any damages or expenses resulting from the aforesaid. Furthermore, Insight Communication Group and its suppliers are not liable for any refunds in the event of overbooking or force majeure or any other cause beyond their control.
18. WITHDRAWAL BY INSIGHT COMMUNICATION GROUP S L
Insight Communication Group S.L. can withdraw from the contract without any grace, if the tenant regardless of a warning by Insight Communication Group S.L. disturb the peace or behave contrary to the terms of the agreement in such a degree that the immediate annulment of the contract is justified. If we terminate for the reasons specified above, then our claim to the entire rent remains; we must however take into account the value of saved expenditures as well as the advantages which we may attain from another reservation of the apartment.
19. NOTICE
Any notice to Insight Communication Group S.L. should be sent to info@dream-flats.com or by fax to + 39 0471 30 39 35 during normal business hours. You must promptly inform Insight Communication Group S.L. of changes in the expiration date of any credit card used in connection with the services; changes in home or billing address; and any actual or suspected apparent breaches of security, such as loss, theft, or unauthorised disclosure. Until Insight Communication Group S.L. is notified of a breach in security, you will remain liable for any unauthorised use of the services. Insight Communication Group S.L. will provide you with copies of billing records documenting charges for use of the services upon request.
20. SALVATORI CLAUSE
If a rule of this agreement should be explained by a responsible court as illegal, that does not touch the validity of the other regulations. If a rule of this agreement is ineffective only in a section, then the other sections keep their validity. The invalid or unenforceable condition will be deemed as supplanted by an enforceable and valid form conveying the same meaning. The non-exclusive law and jurisdiction of the Spanish courts will govern any dispute.
21. AREA OF JURISDICTION
As sole area of jurisdiction for suits against Insight Communication Group S.L. Barcelona is agreed.
22. TRADEMARKS
Insight Communication Group S.L. and its www.dream-flats.com other graphics, logos, and service names appearing on this site are the trademarks of Insight Communication Group S.L. or its respective content suppliers. These trademarks may not be used in connection with any product or service that is not provided by Insight Communication Group S.L. or by its respective content suppliers, in any manner that is likely to cause confusion amongst customers, or in any manner that disparages or discredits the company.
